UPDATE OCTOBER 1, 2025
Nevada Governor Joe Lombardo signed SSA and NVSSA-backed Assembly Bill 137 into law on June 5, 2025, and it takes effect on October 1, 2025. The bill makes three (3) key changes to the advertising section of the Nevada Self Storage Act.
First, it amends the number of times the sale must be advertised from two to one as follows:
2. The owner shall, at least one time in the week immediately preceding the date of the sale, advertise the sale once a week for 2 consecutive weeks immediately preceding the date of the sale in a newspaper of general circulation in the judicial district where the sale is to be held.
As noted above, the law currently requires owners to advertise twice before conducting a sale. Starting October 1, owners are only required to advertise once in the newspaper. This should result in a 50 percent reduction in advertising fees. Additionally, it should reduce some of the compliance issues associated with newspaper advertising since owners are not required to ensure the advertisements run for two consecutive weeks.
Second, the bill reduces the required content of the advertisement as follows:
The advertisement required pursuant to subsection 2 must contain:
- A general description of the personal property to be sold;
- The name of the occupant;
- The number of the individual storage space at the facility where the personal property was stored; and
- The name and address of the facility
AB 137 eliminates the requirement to provide a brief description of the personal property to be sold. This is significant for at least two reasons. First, most newspapers charge by the line, so eliminating the property description should reduce the cost.
Second, for operators to provide a general description of the property, they need to conduct an inventory of the unit. This process opens the operator to claims from the occupant that the operator damaged or stole property during that process. Operators will no longer need to conduct the inventory, which should safeguard against those claims and generally cut down on the administrative time needed to get units ready for auction. However, we do recommend taking several high-quality pictures from the threshold of the unit for any online auctions.
Finally, the amendments provide for an additional compliance mechanism, if an operator does not have a newspaper of general circulation in their area of operation as follows:
4. If there is no newspaper of general circulation in the judicial district where the sale is to be held, the advertisement must be posted 10 days before the sale:
(a) In at least six conspicuous places near the place of the sale; or
(b) On an Internet website which is publicly accessible.
This provision allows operators to advertise auctions on an internet website which is publicly accessible, if the operator does not have a newspaper of general circulation in the judicial district where the sale is to be held. As more newspapers go out of business, this will be very helpful for operators to comply with the law in a much more cost-effective manner.

SSA, Nevada SSA Team Up to Reduce State Newspaper Mandate

First, it amends the number of times the sale must be advertised from two to one. Second, it eliminates the requirement to provide a description of the goods in the advertisement. Finally, it permits online advertising, if there is no newspaper of general circulation in the judicial district where the sale will be held.
An updated Nevada Self Storage Lien Law Annotated booklet will be published in advance of the effective date.
LEGAL UPDATE - SUMMER 2022
Minimum wage increase. The minimum wage in Nevada increased on July 1, 2022. The required rate of pay differs depending upon whether the employer offers qualifying health insurance or not. The minimum wage rate is $9.50 per hour (for employees offered qualifying health benefits), and $10.50 per hour (for employees not offered qualifying health benefits).

BUILDING CODES UPDATE
Changes to the International Building Code Affect Self Storage
With the support of its Code Committee, the Self Storage Association successfully pursued several key changes to the 2021 International Building Code.
- An exception has been added to IBC Section 2902.3.3 to permit an increase in the location (to greater than every other floor) and maximum distance of travel (to greater than 500 ft) for restrooms. The location and travel distance must be approved by the code official.
- The maximum allowable height of sprinklered facilities made of Type IIB materials (unprotected steel) and Type IIIB materials (noncombustible or fire-retardant-treated wood stud exterior walls and any interior construction) has been increased from 3 stories to 4 stories. The Code continues to have total floor and building square footage limits.
- Pursuant to modified IBC Section 903.2.9, storage facilities are exempt from the automatic sprinkler system requirement if: (1) the total fire area is 12,000 sq. ft. or less; (2) the combined total fire areas are 24,000 sq. ft. or less; (3) the facility is no greater than one story above grade plane; and (4) all storage spaces are accessed directly from the exterior.
These changes go into effect as they are adopted by local and state governments over the next several years. Prior to the adoption on the local and state level, storage developers can request that the code official rely on the 2021 changes as acceptable alternative methods of construction pursuant to section 104.11 of the existing International Building Code.
